Home Connectivity Offers – Terms of Commissions.
(a) As material consideration for your marketing commitment set forth in Section 2, subject to offset under Section 5(b), We shall pay You for each Final Sale (as defined below) of the Services (the “Commissions”) at the rates set forth on the Affiliate Portal, which may be modified from time to time by VMC upon prior written notice to You. For purposes of this Agreement, a “Final Sale” means (i) a sale of the Services to a new customer that has not previously subscribed to the Services; (ii) We collect full payment for the Services from such customer and the applicable supplier; (iii) the supplier reports that the Services have been installed and activated by the customer; and (iv) and the sale does not result in a chargeback by the supplier. You are responsible for any sales, use, excise, or similar tax due under this Agreement. In no event shall VMC be responsible for taxes based on your net income or gross receipts.
(b) Commissions payable under this Section 5 are subject to offset for Commissions paid that were not Final Sales because (i) amounts We were unable to collect from suppliers as a direct result of the sale of the Services to a customer; (ii) Services returned, resulting in a charge back, or otherwise canceled by a customer; (iii) Commissions paid to You in error; and/or (iv) orders for the Services were deemed to be fraudulent.
(c) Should You dispute the amount of any Commissions paid to You, all such disputes must be submitted in writing to Us through the Affiliate Portal along with a detailed description of the basis for any such dispute, no later than thirty (30) days after receipt of such Commission. 6. Proprietary Information. Each Party agrees that it will not make use of, disseminate, or in any way disclose any of the other Party’s or a supplier’s Proprietary Information (as defined below) to any other person, firm, or business, except for any purpose the disclosing party may authorize in writing at a later time. “Proprietary Information” shall include, without limitation, performance, sales, financial, contractual and marketing information, ideas, technical data and concepts originated by the disclosing Party, or a party on its behalf, not previously published or otherwise disclosed to the general public, including the terms of this Agreement.
Vonage
1. If your service is cancelled after the 30-day trial period and within two years, you will be subject to a disconnection fee of $39.99. If you received a free phone adapter and your service is cancelled after the trial period and within 180 days, you will be subject to a recovery fee equal to the value of the adapter.
2. Unlimited plan customers get free calls to Italy, France, Spain, UK, and Ireland. Calls to cell phone numbers or to special services numbers such as toll-free or caller-paid information services or 900 numbers in these countries do not apply.
3. We offer a money back guarantee if you terminate your service within 30 days from the date your service is activated. Our money back guarantee applies only to the first-ordered line per account, not to additional or secondary lines. We will refund one credit for the activation fee you paid for the first line that you ordered, the service charge for the first service term( less any overages, 411, toll free, directory assistance or international calls), initial shipping charges, and the $39.99 disconnection fee if you meet the following conditions:
* you cancel within 30 days of the activation of your account
* do not exceed 250 minutes of usage,
* return the equipment at your cost and expense within 14 days of your cancellation in the original packaging and in working condition, and before returning your device to us, you get a valid return authorization number from our Customer Care department which you can reach at 1-VONAGE-HELP.
4. IF ADDITIONAL LINE: The money back guarantee applies to the first line only. There is no cancellation fee for canceling your second line of service.
5. There may be compatibility issues between Vonage and other services such as your alarm system.
6. READ FOR V-PHONE UPSELLS ONLY: Vonage has identified some compatibility issues between Windows Vista and the Vonage V-Phone for which a workaround has been designed. Customers should call the Vonage Tech queue once the V-Phone is received for assistance.

HughesNet® service is available in the contiguous U.S. with an unobstructed view of the southern sky, and its usage is subject to the Fair Access Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Website, or by the overall performance and configuration of your computer. Stated speeds and uninterrupted use of service are not guaranteed. Actual speeds will likely be lower than speed indicated during peak hours.
Listed speeds are available only through Hughes’ newest satellite. The majority of subscribers will have access to these faster speeds. However, approximately 3% of customer locations will have trees or other obstacles that block the signal from the satellite to the home. For these customers, Hughes can offer slightly slower Internet access via another satellite with download speeds up to 700 Kbps, 1.0 Mbps, and 1.5 Mbps; and upload speeds up to 128 Kbps, 200 Kbps and 200 Kbps for Home, Pro and ProPlus service plans, respectively.
